New Jersey poker sites only managed to draw $21.3 million in revenue last year. That figure represents a $3 million reduction from 2017’s figures.
In fact, $21.3 million is $2.5 million less than the market’s previous nadir in 2015. Of course, in 2015, there were also only two networks active, and PokerStars was still a year from entering the market.
Two years later, only one licensee in New Jersey is making any revenue gains in online poker. It’s not PokerStars, either — it’s the Caesars license that houses both WSOP and the 888 networks.
Alarmingly, PokerStars is not even the highest earner in New Jersey anymore. Despite the millions in marketing money poured into the state, the worldwide leader has slipped into second place in the Garden State.

Perhaps the most concerning part about the outcome of 2018 is that New Jersey poker sites were able to use the multi-state compact for much of the year. Since late April, New Jersey poker players have combined with players from Nevada and Delaware to form one large pool of potential table occupants.
It hasn’t helped. At best, poker revenue has remained roughly level since then and dipped below $1.8 million in each of the last four months of the year.
Things are not looking better for 2019, either. The Department of Justice (DOJ)issued an opinion in January that the Wire Act, which prohibits betting over electronic devices in specific contexts, actually affects all online gambling.
If the DOJ happens to instruct its prosecutors to place the enforcement of this opinion high in their priorities, the multi-state compact may become a thing of the past. Even though it hasn’t helped New Jersey sites, taking it away wouldn’t be a good thing either.
It’s not like the operators don’t have other options
Operators may also be growing tired of expending resources to keep such a low-profit venture going. From their perspective, there are far better uses of time and money than online poker in New Jersey.
One of those uses is online casino gambling. On a pure revenue basis, online gambling has earned more than seven times the revenue of online poker since each of their launches.
The situation grows even direr as time passes. In December 2018, online casinos held $27.2 million against online poker’s $1.8 million. In other words, online casinos now earn more than 15 times what online poker does.
Gaming operators could also reasonably turn their attention toward sports betting before online poker. Online sports betting in New Jersey earned $14.7 million in December 2018.
Like all businesses, casino operators must consider the opportunity costs of their various endeavors. In other words, they must determine how much business they will lose in pursuing a particular option versus how much that option will pay off.
Unfortunately, there are plenty of legitimate reasons that New Jersey site owners could decide that poker simply isn’t worth the trouble.
So, which sites are on deathwatch?
There are three license holders in New Jersey that have poker networks active on them. They combine to host four networks and seven sites or skins. They are:
- Borgata
- Borgata Poker network
- Pala Poker
- Borgata Poker network
- Caesars
- WSOP network
- 888 network
- Resorts
- PokerStars network
Of the license holders that host poker, Borgata is the weakest of the three. The four sites or skins that operate on Borgata’s network have struggled to earn $400,000 per month since the introduction of the multi-state compact.
So, we have to consider Borgata Poker, playMGM Poker, partypoker and Pala Poker to be on the bubble. Dividing $400k between these four sites doesn’t seem to be worth the time, particularly for a company the size of MGM.
However, there are indicators that MGM is committed to online poker, generally speaking. Pennsylvania is now accepting applications for online gambling from outside interests, and MGM included online poker in its application to operate in Pennsylvania. To do so, MGM had to pay a $4 million licensing fee.
So, it’s possible that providing online poker is a matter of principle for MGM. We just don’t know how much MGM values principle over profitability.

Online poker is now an entrenched part of the New Jersey online gaming industry.
After a couple of failed attempts over a three-year period, New Jersey lawmakers finally got then-Governor Chris Christie to sign into law an online gambling bill that included online poker legislation in February 2013.
The bill authorized the New Jersey Division of Gaming Enforcement (DGE) to put together regulations that would govern online poker in the state. Plus, it asked the board to issue internet gaming licenses to vetted potential operators affiliated with Atlantic City casinos.
At the time, New Jersey became the third state in US history to legalize online poker. Delaware and Nevada were the first two. Plus, Pennsylvania has since done the same, becoming the fourth state.
Delaware and Nevada signed an agreement to share player pools in 2014, and began doing so in 2015. New Jersey signed onto that agreement in October 2017.

New Jersey online poker laws
The online gambling bill signed into law by Christie on Feb. 26, 2013 is officially known as A2578. It governs online poker and online casino operations in the state.
In fact, the law authorized the DGE to provide oversight and issue licenses for online gambling operators in New Jersey. Essentially, the law allows the sites to provide division-tested online poker and casino games to players who are 21 and older and physically located in the state.
On Nov. 21, 2013, six online poker sites launched in New Jersey. Two have since ceased operations. However, three more have been licensed and opened up in the state since that time.
What is or is not legal in New Jersey?
Anytime you are in the state of New Jersey, you can legally play real-money online poker. Provided you play on sites licensed and regulated by DGE. No matter where you’re from.
However, sites and players must adhere to specific online poker regulations set by DGE. These regulations include:

History of online poker in New Jersey
The popularity of online poker rose immensely across the US in 2003 after a Tennessee accountant aptly named Chris Moneymaker won the World Series of Poker (WSOP) Main Event. The key was that Moneymaker won his way into the tournament through an online satellite, giving millions of Americans the idea they could be next.
Additionally, the sudden advent of hole-card cameras also made the live game infinitely more watchable on TV. Americans tuned in big time to WSOP and World Poker Tour coverage where every commercial break was filled with spots for offshore online poker sites, selling the game to the masses.
Congress tried to put an end to offshore operators’ dominance of the budding industry by passing the Unlawful Internet Gambling Enforcement Act in 2006. In fact, this made it illegal for US banks to deal with the sites. It did it push a handful of operators out of the US market. However, it didn’t stop US players from playing.
In fact, the sites still accepting US players found ways around the law and online poker continued to grow.
New Jersey’s first look at online gambling legislation
Some four years later, New Jersey nearly became the first state to legalize and regulate online poker and casino gambling in the US.
In fact, State Sen. Raymond Lesniak introduced a bill that would allow Atlantic City casinos to operate internet casinos within the state in early 2010. State Assemblyman John Burzichelli introduced a similar bill later in the year. Then, in early 2011, both branches of the state legislature passed an amended version of it.
However, fearing the law might attract a wave of new internet cafes around the state that would effectively be unauthorized casinos, Christie vetoed the bill in March 2011.
Then, on April 15, 2011, the U.S. Department of Justice (DOJ) indicted executives at the largest offshore online poker operators. This included PokerStars, Full Tilt Poker, and Absolute Poker/Ultimate Bet. The DOJ charged them with various money laundering and illegal gambling offenses. Plus, the online poker site domains were seized. US players were suddenly out of the game.

However, before Christie had a chance to sign it into law, Delaware and Nevada moved forward with legalizing and regulating different forms of online gambling, including online poker. Additionally, in February 2013, Christie again vetoed New Jersey’s online gambling bill.
This time he said the bill needed a higher tax rate. Finally, changes were made and on Feb. 26, 2013, the Assembly and Senate passed a revised bill. Gov. Christie signed the bill into law later that same day, allowing New Jersey to become the third state in the nation to pass online poker legislation.
On Nov. 21, 2013, New Jersey allowed a synchronized soft launch of seven online casinos and six online poker sites owned, operated or affiliated with six of Atlantic City’s casinos.
